By using Clubby, you agree to:

• Account Responsibility: You are solely responsible for all activity under your account. One account per person.
• Accurate Information: You must provide truthful, accurate information during registration and maintain current account details.
• Age Requirement: You must be at least 18 years old, or 13+ with verified parental consent.
• Payment Obligations: You agree to pay for all booked services. Payments are processed at booking time.
• Platform Fees: A 15% platform fee is added to athlete prices.
• Dispute Resolution: Disputes are resolved through our internal review process using call recordings.

We collect and process your data as follows:

• Personal Information: Name, email, payment details, and identity verification documents.
• Usage Data: Device info, IP address, browsing patterns, and transaction history.
• Video Recordings: All calls are recorded and stored securely for safety purposes.
• Data Sharing: We share data with payment processors (Stripe), video call services, and law enforcement when required.
• Data Retention: We retain your data as long as your account is active, plus legal retention periods.

By accepting, you explicitly consent to:

• All video and audio being captured during scheduled and live calls
• Recordings being stored on our secure servers for up to 90 days (or longer for disputes)
• Recordings being reviewed by Clubby staff for dispute resolution and safety enforcement
• Recordings being shared with law enforcement if required by legal process
• You waive any expectation of privacy during calls conducted through the platform

You cannot use Clubby without consenting to call recording.

Prohibited Conduct:

• Harassment, threats, bullying, or abusive language
• Sexual content, nudity, or sexually suggestive behavior
• Discrimination based on any protected characteristic
• Sharing personal contact information to circumvent the platform
• Recording calls outside the platform's official system
• Impersonation, fraud, or misrepresentation
• Discussion of illegal activities

Consequences of Violations:

• Immediate call termination without refund
• Monetary fines charged to your payment method
• Temporary or permanent account suspension
• Legal action and reporting to authorities for serious violations

Athletes may end calls early for misconduct. You will still be charged the full amount.

By accepting this waiver, you agree:

• Assumption of Risk: You voluntarily assume all risks associated with using the platform and participating in video calls with athletes.
• Release of Claims: You release Clubby, its officers, employees, and athletes from any and all claims, damages, or causes of action arising from your use of the platform.
• Indemnification: You agree to indemnify and hold harmless Clubby from any claims brought by third parties arising from your conduct.
• Limitation of Liability: Clubby's total liability is limited to the amount you paid for the specific service at issue.
• Binding Arbitration: Any disputes will be resolved through binding arbitration, not in court.
• Class Action Waiver: You waive any right to participate in class action lawsuits against Clubby.
• No Warranties: The platform is provided "as is" without warranties of any kind.

This waiver is governed by the laws of Delaware. If any provision is found unenforceable, the remaining provisions remain in effect.

By checking this box, you confirm and declare under penalty of perjury that:

• You are at least 18 years of age, OR
• You are between 13-17 years of age AND have obtained verifiable parental or guardian consent
• You have the legal capacity to enter into binding agreements
• You are not prohibited from using this service by any applicable law

Misrepresenting your age is a violation of our Terms and may result in immediate account termination and legal action.
