1. Acceptance of Terms

By accessing or using Clubby (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. These terms apply to all users, including fans, athletes, and administrators.

2. Account Registration & Identity Verification

All users must create an account using their legal identity. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security of your account credentials
Complete identity verification when required
Not create accounts for others or transfer your account
Be at least 18 years old or have parental consent if between 13-17

Identity verification helps maintain accountability and safety for all users. Failure to verify your identity may result in limited platform access.

3. Video Call Services

Clubby facilitates paid video calls between fans and athletes. By using this service:

Athletes set their own availability and pricing for video calls
Fans book and pay for time slots in advance
A 15% platform fee is added to the athlete's listed price
All video calls are conducted through our integrated video platform
Calls are scheduled for the agreed-upon duration (typically 15-60 minutes)

4. Call Recording & Security

IMPORTANT: All video calls on Clubby are recorded.

By using our video call services, you explicitly consent to:

All video and audio being recorded during scheduled calls
Recordings being stored securely on our servers for safety and compliance purposes
Recordings being reviewed in case of disputes or reported violations
Recordings being retained for up to 90 days after the call, or longer if required for dispute resolution

Recordings are used solely for platform safety, dispute resolution, and legal compliance. They are not shared publicly or used for marketing purposes.

5. Conduct Guidelines

All users must maintain respectful and appropriate conduct during video calls. Prohibited behavior includes:

Harassment, bullying, threats, or abusive language
Discrimination based on race, gender, religion, or any protected characteristic
Sexual content, nudity, or sexually suggestive behavior
Sharing or requesting personal contact information to circumvent the platform
Recording calls outside of the platform's official recording system
Impersonation or misrepresentation of identity
Discussing illegal activities or soliciting illegal services
Spam, scams, or fraudulent behavior

6. Athlete Rights & Call Termination

Athletes have the right to:

End any call early if they feel uncomfortable or if the fan violates conduct guidelines
Receive full payment for the scheduled call duration, even if ended early due to fan misconduct
Report inappropriate behavior for review
Block specific users from booking future calls
Set their own availability and pricing

If a call is ended early due to athlete misconduct, the fan may be entitled to a partial or full refund.

7. Payments & Fees

Athletes set their base price per call duration
Fans pay the athlete's price plus a 15% platform fee
Payment is processed at the time of booking
Athletes receive their earnings after successful call completion
Refunds are issued at Clubby's discretion based on dispute outcomes

8. Dispute Resolution

If issues arise during or after a call:

Either party may file a dispute within 48 hours of the call
Disputes are reviewed using call recordings and account history
Clubby will make a determination within 5-7 business days
Decisions may include refunds, account warnings, or account suspension
Repeated violations may result in permanent account termination

9. Liability & Fan Accountability

Fans who violate conduct guidelines may be subject to:

Forfeiture of refunds for terminated calls
Additional charges or fines at Clubby's discretion
Temporary or permanent account suspension
Legal action in cases of serious misconduct
Reporting to relevant authorities if illegal activity is suspected

10. Intellectual Property

All content on Clubby, including logos, designs, and software, is owned by Clubby or its licensors. Users may not copy, modify, or distribute platform content without permission. Athletes retain rights to their own likeness and personal brand.

11. Termination

Clubby reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or harm the platform community. Users may also close their accounts at any time through account settings.

12. Changes to Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or platform notification.
